Buy And Sell a propertyWhat conveyancers say
Conveyancers handle the legal work on every sale, from searches to exchange and completion. Hear from practitioners, a law trainer and a senior judge on how the Gazeal Reservation Agreement works in practice.
His Honour Judge Simon Staley Brown KC
His Honour Judge Simon Staley Brown KC, a barrister and senior circuit judge specialising in property and business disputes, chairs Gazeal’s arbitration panel. Speaking to conveyancers, he says the Gazeal Reservation Agreement will fit the vast majority of residential property transactions. If a conveyancer thinks it’s not appropriate for a client, he advises recording that advice and the reasons for it, because if the sale later falls through, he sees it as difficult to say the conveyancer wouldn’t be liable for the client’s loss. He believes the agreement improves the client’s experience through early information about the property and a fast, simple way to resolve disputes. He describes it as clear, simple and fair, and says a competent conveyancer can read and understand it in minutes.

Lorraine Richardson, an experienced property solicitor and legal trainer who has worked with the Law Society, BPP and the College of Law, says Gazeal’s innovations will vastly improve the conveyancing process. She is also a consultant to Gazeal, as head of professional legal practice. In the Gazeal Reservation Agreement, she says, the circumstances in which a Buyer can withdraw are specific and clearly defined, which removes much of the room for argument, and the Seller is tied in too. She advises conveyancers to read it, and says she is confident it is in the best interests of the majority of conveyancing clients.
Watch VideoDavid Jabbari, CEO, Muve
David Jabbari, a solicitor and the CEO of conveyancing firm Muve, explains why Muve works with Gazeal. He says Gazeal’s early property information, collected when a home is listed at no cost to the Seller or Agent, lets Buyers learn about the property before they make an offer. Under the Gazeal Reservation Agreement, both parties make a mutual financial commitment, which they forfeit only if they withdraw unreasonably. Reasonable grounds include a bad title, a refused mortgage, a survey that reveals large works or a collapsed chain. Muve offers free telephone advice on whether it suits your circumstances.

Stuart Forsdike, a licensed conveyancer and founder partner of PCS Legal, says his firm has worked with Gazeal for around three years. PCS Legal is a high volume firm with offices including Basildon, Wickford and London. He says clients get more certainty and their transactions conclude much quicker, and the firm’s cash flow has improved because matters leave the desk sooner. Because Sellers complete the forms and owner’s tasks at the start, Buyers see everything before they offer, which he estimates saves a good month of backwards and forwards. He says the firm hasn’t had any problems. PCS Legal gives an estimate of costs by phone or email.
Watch VideoRob McKellar, Slater and Gordon Lawyers
Rob McKellar, a lawyer specialising in residential property and legal technology, explains why Slater and Gordon likes working with the Gazeal Reservation Agreement. He says it improves the conveyancing journey through transparency, certainty and speed. Gazeal’s buyer’s information pack gives Buyers the information that the Law Society protocol forms would normally contain before they make an offer, rather than weeks later. The agreement is a single page of simple language, and because Gazeal guarantees each party’s financial commitment, no deposit is needed, so it can be put in place quickly. Slater and Gordon also offer a free 10 minute consultation to talk it through.
